LEND A TRAILER, LLC TERMS OF SERVICE These Terms of Service (“Terms”) constitute a legally binding agreement between you and Lend a Trailer, LLC, a Michigan limited liability company (“Lend a Trailer,” “LAT,” “we,” “our,” “us” or “lendatrailer.com”). By accessing or using the Lend a Trailer website, platform, or services (collectively, the “Platform”), you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform. LAT operates solely as an advertising and listing platform. LAT does not own, control, manage, inspect, or operate any trailers, nor do we participate in, or receive any compensation from, any rental transactions between users. Any reference of lendatrailer.com shall be interchangeable with LAT. DEFINITIONS Trailer. “Trailer” means any nonmotorized vehicle, platform, or conveyance designed to be attached to and towed by a motor vehicle through a hitch, coupler, or similar connection, and used for transporting goods, equipment, materials, recreational items, or other personal property. This includes, without limitation, utility trailers, cargo trailers, flatbed trailers, enclosed trailers, equipment haulers, car haulers, boat trailers, and similar towbehind units. “Trailer” does not include manufactured homes, mobile homes, travel trailers, campers, RVs, or any structure designed or used for human habitation, temporary lodging, or residential purposes.

ELIGIBILITY AND USER ACCOUNTS 1.1 Eligibility. You must be at least eighteen (18) years old and legally able to enter binding contracts to use the Platform. 1.2 Account Information. You agree to provide accurate, current, and complete information when creating an account and to maintain and update such information as needed. 1.3 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. 1.4 Account Standing. LAT may, in its sole discretion, determine whether an account is in good standing. Accounts not in good standing may be restricted from renewing subscriptions, adding listings, or accessing certain features. 1.5 Use Conditions. Your use of the Platform does not create or constitute any employment, contractor, joint venture, partnership, fiduciary, or agency relationship between you and LAT. By accessing or using the Platform, you acknowledge and agree that LAT does not hire, engage, supervise, direct, or control you in any capacity, and that no provision of these Terms shall be interpreted as establishing any form of employment or independent contractor relationship. You use the Platform solely for your own personal or commercial purposes, including listing, advertising, lending, or renting trailers, and you act exclusively on your own behalf. LAT does not represent you, act as your agent, negotiate transactions for you, or assume any responsibility for your interactions or agreements with other users. All decisions regarding trailer listings, pricing, communications, rental arrangements, and related activities are made independently by you and at your own discretion. Nothing in these Terms authorizes you to bind LAT, speak on its behalf, or hold yourself out as an employee, agent, representative, or partner of the company. LAT provides an advertising and listing service only, and all users remain solely responsible for their own conduct, obligations, and compliance with applicable laws.
PLATFORM ROLE AND LIMITATIONS 2.1 Advertising Platform Only. LAT provides an online venue where trailer owners may advertise trailers for rent and renters may contact owners. LAT is not a party to any rental agreement, transaction, or communication between users. 2.2 No Payments. LAT does not process, collect, hold, or transmit rental payments, security deposits, or any other funds on behalf of users. 2.3 No Verification. LAT does not verify: (a) trailer ownership; (b) trailer condition, safety, roadworthiness, or compliance; (c) accuracy or completeness of listings; (d) identity, background, or trustworthiness of users. 2.4 No Endorsement. LAT does not endorse any user, listing, trailer, or transaction. 2.5 User Responsibility. All interactions, negotiations, agreements, payments, inspections, safety checks, and due diligence are solely between the owner and renter. 2.6 No Guarantee. LAT does not guarantee that any trailer will be rented, that any user will perform under any agreement, or that the Platform will result in any particular outcome.
CRIMINAL RECORDS AND SAFETY POLICY 3.1 Safety Priority. LAT seeks to maintain a reasonably safe community but does not and cannot guarantee the safety, background, or conduct of any user. 3.2 Criminal History. LAT may, but is not obligated to, review publicly available information or user‑provided information regarding criminal history. LAT reserves the right, in its sole discretion, to: (a) deny, suspend, or terminate accounts based on criminal history; (b) remove or restrict listings where criminal conduct is suspected or confirmed; (c) permanently bar users for serious offenses. 3.3 Severity and Timing. Without limiting the foregoing, LAT may: (a) review minor offenses on a case‑by‑case basis; (b) remove or permanently bar users for moderate or severe offenses (including, but not limited to, felony theft, fraud, property damage, or violent crimes) occurring within a reasonable lookback period determined by LAT; (c) deactivate listings if a user is arrested for a felony while advertising on the Platform, pending further review. 3.4 No Duty to Screen. LAT has no duty to conduct background checks and does not represent that any user has been screened. Users are solely responsible for conducting their own due diligence.
OWNERS AND AUTHORIZED AGENTS 4.1 Ownership Requirement. Only the legal owner of a trailer, or an individual expressly authorized by the owner, may create a listing. 4.2 Authorized Agents. Owners may designate an agent to manage a listing. Authorized agents: (a) must be disclosed to LAT; (b) must act solely on behalf of the owner; (c) must have actual authority from the owner to manage the listing and communications. 4.3 Proof of Ownership or Authorization. LAT may request documentation to confirm: (a) trailer ownership; (b) the identity of the owner; (c) the authority of any agent acting on behalf of the owner. Failure to provide proof may result in suspension, removal of the listing, or termination of the account. 4.4 Single‑Trailer Listing Integrity. Each listing is associated with a specific trailer. Owners and authorized representatives: (a) may not switch a listing between multiple trailers; (b) may not use one listing to advertise multiple trailers; (c) must create separate listings for each trailer they wish to advertise. 4.5 Transfer of Listings. Listings and remaining subscription time: (a) may not be transferred to a new owner of the trailer; (b) may not be transferred to another trailer; (c) may not be reassigned between different accounts without LAT’s prior written consent. 4.6 Additional Trailers. LAT may, in its discretion, offer discounted rates for additional trailer listings under the same account. Such discounts, if any, are subject to change without notice. 4.7 Post‑Expiration Retention. Upon expiration of a subscription: (a) the listing may be deactivated; (b) LAT may retain listing data for a limited period (e.g., thirty (30) days) for potential reactivation; (c) after such period, the listing may be treated as a new agreement requiring re‑entry of information.
RENTER RESPONSIBILITIES Renters are solely responsible for: (a) verifying trailer condition, safety, and suitability for their intended use; (b) confirming ownership and legitimacy of the listing; (c) ensuring proper towing equipment, licensing, and insurance; (d) complying with all laws, regulations, and safety requirements; (e) negotiating and executing rental agreements directly with owners; (f) conducting their own due diligence regarding the owner’s identity, reliability, and compliance. LAT DOES NOT GUARANTEE THE ACCURACY, SAFETY, OR LEGALITY OF ANY TRAILER OR LISTING.
RENTER AND OWNER LEGAL COMPLIANCE 6.1 Owner Compliance. Owners are solely responsible for complying with all applicable laws, rules, and regulations relating to: (a) trailer ownership, registration, and titling; (b) safety standards, inspections, and roadworthiness; (c) insurance requirements; (d) taxes, including income, sales, and use taxes; (e) permits, licenses, and regulatory approvals; (f) data privacy and security obligations arising from their own practices; (g) anti‑discrimination and fair‑housing‑analogous laws where applicable (e.g., non‑discriminatory treatment of renters). 6.2 Renter Compliance. Renters are solely responsible for: (a) complying with towing laws, weight limits, and licensing requirements; (b) ensuring their vehicle is capable of safely towing the trailer; (c) obtaining any necessary permits or approvals for use of the trailer; (d) complying with all applicable traffic, safety, and camping or parking regulations. 6.3 No Legal Advice. LAT does not provide legal, tax, or regulatory advice. Users should consult their own advisors.
USER‑GENERATED CONTENT 7.1 Content Ownership. Users retain ownership of content they submit but grant LAT a non‑exclusive, worldwide, royalty‑free, sublicensable, irrevocable license to: (a) use, display, reproduce, distribute, and store such content; (b) create derivative works from such content; (c) use such content in any media now known or later developed for Platform operation, promotion, and advertising. 7.2 Name, Image, and Likeness. To the extent user content includes a user’s name, image, or likeness, the user grants LAT the right to use such elements in connection with the content license above. 7.3 Non‑Confidentiality. User content submitted to the Platform is not confidential or proprietary. Users should not submit sensitive or confidential information. 7.4 Content Requirements. Users may only upload content they own or have rights to use. Users represent and warrant that: (a) they have all necessary rights to grant the licenses in this Section; (b) their content does not infringe any third‑party rights; (c) their content complies with these Terms and applicable law. 7.5 Content Removal. LAT may review, update, modify, or delete any user‑submitted content at its sole discretion, with or without notice, including content that: (a) violates these Terms; (b) infringes third‑party rights; (c) is misleading, fraudulent, or inappropriate; (d) LAT otherwise deems unsuitable for the Platform. 7.6 Inappropriate Content. Users agree only to post appropriate content. Users shall not post content that: (a) contains nudity, profanity, vulgarity; (b) contains descriptions or images of illicit or illegal activity; (c) depicts people, children, or anyone under the age of 18 years old; (d) contains otherwise sensitive, or insincere information or images. Images posted to LAT should not contain photographs of people, and should depict only the trailer being listed to the platform. LAT reserves the right to suspend, ban, or limit accounts which violate these Terms.
PHOTO AND MEDIA GUIDELINES 8.1 Photo Ownership. Users may only upload photos and media they personally own or have the legal right to use. 8.2 Prohibited Photos and Media. Users may not upload: (a) copyrighted photos or media without permission; (b) photos containing third‑party logos, watermarks, or branding (unless the logo is owned by a user operating as a trailer dealer); (c) floor plans, maps, or other copyrighted materials owned by third parties; (d) collages or images composed of multiple photos in a single file; (e) photos depicting nudity, sexually explicit content, illegal drugs, illegal activities, or obscenity. (g) photos generated, modified, enhanced, compiled, or sequenced under the use of Artificial Intelligence. Users may only post accurate representations of their trailers. 8.3 Video Links. Users may: (a) share video links (e.g., to their own video channels) only where the video is focused on the listed trailer; (b) not share video links that advertise third‑party businesses or unrelated services; (c) not share video links that contain third‑party advertising or promote other platforms. 8.4 Copyright Liability. By uploading photos or media, users agree: (a) they will be held liable for any copyright infringement arising from their uploads; (b) LAT may remove copyrighted or infringing content without notice; (c) LAT may deactivate or terminate subscriptions for repeated or serious violations. 8.5 Use of Photos by LAT. By uploading photos or media, users agree that: (a) LAT may use such photos and media to advertise the user’s listing on the Platform; (b) LAT may use such photos and media in paid or unpaid advertising, including on social media and other channels; (c) LAT may store, reproduce, and display such photos and media as part of the Platform and its promotional efforts.
PROHIBITED CONDUCT Users may not: (a) post false, misleading, or fraudulent listings; (b) list trailers they do not own or are not authorized to manage; (c) post multiple trailers under a single listing; (d) use bots, scrapers, or automated tools to access or interact with the Platform; (e) engage in harassment, fraud, or unlawful conduct; (f) attempt to circumvent Platform features, security, or enforcement mechanisms; (g) use the Platform to collect user contact information for unrelated or off‑Platform purposes in a deceptive or abusive manner. LAT may suspend or terminate accounts for violations.
AVAILABILITY, CALENDAR, AND INQUIRY RESPONSE 10.1 Accuracy of Availability. Owners and authorized agents are responsible for: (a) maintaining accurate availability information for their trailers; (b) promptly updating calendars when dates are booked or unavailable; (c) avoiding listing availability unless they are prepared to rent the trailer for those dates. 10.2 Inquiry Response Time. Owners and authorized agents agree to: (a) respond to inquiries within a reasonable period, typically twenty‑four (24) to forty‑eight (48) hours; (b) maintain current contact information so they can be reached regarding inquiries. 10.3 Outdated Dates. LAT may, at the start of each new year or at other intervals: (a) remove prior‑year dates and rates from listings; (b) require owners to refresh or update their availability and pricing.
CONTACT INFORMATION IN LISTINGS 11.1 Public Contact Information. For user security and privacy, LAT may restrict the display of certain contact information in listing descriptions. Users agree that: (a) they may be prohibited from including email addresses, phone numbers, last names, or full physical addresses in the public description fields; (b) such information may be removed without notice if posted in prohibited areas. 11.2 Platform Communication Tools. Renters may contact owners through Platform‑provided tools (e.g., contact forms or messaging features). Owners are responsible for monitoring and responding to such communications.
SERVICES, CHANGES, AND DOWNTIME 12.1 Changes to Services. LAT may, without notice, withdraw, modify, or change any aspect of the Platform, including: (a) features, tools, or functionalities; (b) subscription plans and pricing; (c) availability of certain regions or categories. 12.2 Downtime and Disruptions. LAT does not guarantee uninterrupted access to the Platform. Users acknowledge that: (a) technical issues, maintenance, or updates may cause temporary unavailability; (b) third‑party service providers (e.g., hosting, payment processors) may experience outages; (c) LAT is not liable for any loss or damage arising from such disruptions. 12.3 No Refunds for Downtime. As further described in Section 14, LAT does not provide refunds for downtime, service disruptions, or changes to the Platform.
SUBSCRIPTION FEES, PAYMENTS, AND CHARGEBACKS 13.1 Subscription Fees. Owners pay subscription fees to list trailers. Fees: (a) are set by LAT and may change from time to time; (b) are typically charged on a recurring or term basis (e.g., annual); (c) are non‑refundable except where required by law or expressly stated otherwise. 13.2 Renewals. For accounts in good standing: (a) LAT may send renewal notices or invoices prior to subscription expiration; (b) if a subscription is not renewed, the listing may be deactivated; (c) LAT may retain listing data for a limited period (e.g., thirty (30) days) for potential reactivation. 13.3 Chargebacks. If a user initiates a chargeback: (a) the user forfeits the ability to continue using the Platform under the affected subscription; (b) the user’s account may be deactivated and listings removed; (c) any attempt to re‑register may be subject to a service fee (e.g., forty dollars ($40)); (d) LAT may, in its discretion, refund any remaining payment after deducting the service fee. 13.4 No Refunds. Except as required by law or expressly approved by LAT: (a) subscription payments are non‑refundable; (b) no refunds will be given for early cancellation, deactivation, or termination; (c) if a refund exception is approved, LAT may charge a service fee (e.g., forty dollars ($40)).
NO REFUND POLICY AND UNFORESEEN CIRCUMSTANCES 14.1 No Refund Policy. LAT does not provide refunds for: (a) service disruptions; (b) downtime; (c) changes to features or services; (d) account suspension or termination for violations of these Terms. 14.2 Unforeseen Circumstances. Users acknowledge that certain events are beyond LAT’s control, including: (a) technical issues, server failures, or system maintenance; (b) natural disasters, extreme weather, or other force majeure events; (c) acts of terrorism, war, civil unrest, or government actions; (d) failures or limitations of third‑party service providers (e.g., hosting, internet, software dependencies). Such events do not entitle users to refunds.
SELLING YOUR TRAILER WHILE LISTED 15.1 Trailers for Sale. Users may not sign up to advertise a trailer for sale on this platform. 15.2 Concurrent Sale and Rental. If an owner decides to sell a trailer while it is listed for rent: (a) the owner must ensure that any existing or future rental commitments can be honored or clearly disclosed; (b) LAT may, in its discretion, add a banner or notice to the listing indicating that the trailer is for sale; (c) the owner must promptly inform renters of any potential impact on their rental plans. 15.3 Renewal While Selling. LAT may, in its discretion: (a) decline to renew a rental listing for a trailer that is actively being sold; (b) require the owner to choose between continuing rental advertising or focusing solely on sale efforts.
NO WARRANTIES 16.1 Platform Warranty. The Platform is provided “as is” and “as available.” LAT disclaims all warranties, express or implied, including: (a) merchantability; (b) fitness for a particular purpose; (c) accuracy or reliability of listings; (d) safety or condition of trailers; (e) non‑infringement. Lat does not guarantee uninterrupted or error‑free service.
LIMITATION OF LIABILITY 17.1 General Limitation of Liability. To the fullest extent permitted by law: (a) LAT is not liable for any injury, accident, property damage, theft, loss, fraud, or dispute arising from trailer rentals or user interactions; (b) LAT is not liable for indirect, incidental, special, consequential, or punitive damages; (c) LAT’s total liability shall not exceed the amount of subscription fees paid by the user in the preceding twelve (12) months. 17.2 Trailer Safety, Defects, and Accident Disclaimer. Users acknowledge and agree that trailers listed on the Platform may involve inherent risks, including risks arising from towing, loading, unloading, operating, maintaining, storing, or occupying a trailer. Users further acknowledge that trailers may contain defects, mechanical issues, structural weaknesses, improper repairs, inadequate maintenance, faulty components, or unsafe modifications, and that LAT has no ability or obligation to detect, prevent, or warn about such conditions. To the fullest extent permitted by law, Users understand and agree that: (a) LAT does not inspect, maintain, repair, certify, or guarantee the condition, safety, roadworthiness, legality, or suitability of any trailer; (b) LAT does not verify whether a trailer is properly equipped with functioning brakes, lights, tires, hitches, safety chains, breakaway systems, weightdistribution systems, or any other required safety equipment; (c) LAT does not assess whether a renter’s tow vehicle, hitch system, driving experience, or load configuration is safe or appropriate; (d) all risks associated with trailer defects, failures, malfunctions, improper maintenance, improper loading, improper hitching, or unsafe operation are borne solely by the Users; (e) LAT shall have no liability whatsoever for any bodily injury, death, property damage, economic loss, or other harm arising out of or relating to the condition, use, towing, operation, or malfunction of any trailer listed on the Platform; and (f) Users are solely responsible for conducting their own inspections, safety checks, due diligence, and verification before renting, towing, or using any trailer. Users expressly waive and release any claims against LAT arising from or relating to trailer defects, mechanical failures, tire blowouts, brake failures, structural failures, hitch failures, load shifts, towing incidents, collisions, rollovers, or any other accidents or occurrences involving a trailer. 17.3 Assumption of Risk. Users acknowledge that towing, operating, loading, unloading, and occupying trailers involves significant risks, including the risk of accidents, collisions, rollovers, equipment failures, bodily injury, death, and property damage. By using the Platform, Users voluntarily and knowingly assume all such risks, whether known or unknown, foreseeable or unforeseeable, and agree that LAT shall have no responsibility or liability for any harm arising from such risks. USERS ACKNOWLEDGE THAT THEY ACCESS AND USE THE PLATFORM VOLUNTARILY AND AT THEIR OWN RISK, AND THAT ALL TRAILER RENTALS, COMMUNICATIONS, AND INTERACTIONS WITH OTHER USERS ARE UNDERTAKEN SOLELY AT THEIR OWN DISCRETION. USERS UNDERSTAND AND AGREE THAT LEND A TRAILER, LLC (“LAT”) OPERATES ONLY AS AN ADVERTISING AND LISTING PLATFORM AND IS NOT A PARTY TO, AND HAS NO CONTROL OVER, ANY RENTAL AGREEMENTS, PAYMENTS, TRAILER USE, OR OTHER TRANSACTIONS BETWEEN USERS. LAT DOES NOT OWN, INSPECT, MAINTAIN, CERTIFY, ENDORSE, VALIDATE, OR WARRANT ANY TRAILER, LISTING, USER, OR REPRESENTATION MADE ON OR THROUGH THE PLATFORM, AND DOES NOT REVIEW OR VERIFY POSTS, DESCRIPTIONS, PHOTOS, AVAILABILITY, PRICING, SAFETY, LEGALITY, INSURANCE, REGISTRATION, OR ROADWORTHINESS FOR ACCURACY OR COMPLETENESS. USERS ARE SOLELY RESPONSIBLE FOR CONDUCTING THEIR OWN DUE DILIGENCE, INCLUDING VERIFYING OWNERSHIP, IDENTITY, CONDITION, SAFETY, SUITABILITY, AND LEGALITY OF ANY TRAILER OR USER, AND FOR COMPLYING WITH ALL APPLICABLE LAWS, REGULATIONS, AND INSURANCE REQUIREMENTS. TO THE FULLEST EXTENT PERMITTED BY LAW, USERS EXPRESSLY RELEASE LAT FROM, AND LAT SHALL HAVE NO RESPONSIBILITY OR LIABILITY FOR, ANY CLAIMS, LOSSES, INJURIES, ACCIDENTS, DAMAGES, DISPUTES, OR OTHER CONSEQUENCES ARISING OUT OF OR RELATED TO TRAILER RENTALS, USE OF TRAILERS, USER CONDUCT, OR RELIANCE ON ANY INFORMATION OR CONTENT MADE AVAILABLE THROUGH THE PLATFORM.
INDEMNIFICATION Users agree to indemnify, defend, and hold harmless Lend a Trailer, LLC (“LAT”), its owners, members, managers, employees, contractors, affiliates, successors, and agents from and against any and all claims, demands, actions, suits, liabilities, losses, damages, judgments, settlements, fines, penalties, costs, and expenses (including reasonable attorneys’ fees and litigation costs) arising out of or relating to:

any listing, advertisement, description, photograph, video, or other content submitted, posted, or provided by the user;
the ownership, condition, maintenance, operation, use, towing, storage, safety, roadworthiness, or legality of any trailer listed by the user;
any rental, lease, loan, reservation, agreement, or transaction between users, including negotiations, payments, cancellations, disputes, or performance of such agreements;
any bodily injury, death, property damage, theft, loss, or other harm occurring in connection with a trailer rental or user interaction;
any violation of federal, state, or local laws, regulations, ordinances, licensing requirements, towing requirements, insurance requirements, or safety standards by the user;
any dispute, disagreement, or conflict between users, including claims of fraud, misrepresentation, breach of contract, or failure to perform;
any actual or alleged infringement, misappropriation, or violation of copyrights, trademarks, rights of publicity, privacy rights, or other intellectual property or proprietary rights;
any breach of these Terms or of any representations, warranties, or obligations made by the user;
any misuse of the Platform, including attempts to circumvent Platform rules, redirect users, or engage in unauthorized commercial activity; and
any claims brought by third parties arising from or relating to the user’s conduct, content, trailer, or transactions. This indemnification obligation applies to the fullest extent permitted by law and survives termination of the user’s account, removal of listings, or discontinuation of Platform access.

DISPUTE RESOLUTION BETWEEN USERS AND RELEASE 19.1 User Disputes. LAT is not responsible for disputes between users and has no obligation to mediate or resolve them. All disputes must be handled directly between the owner and renter. 19.2 Release. Users, to the fullest extent permitted by law, irrevocably release and forever discharge Lend a Trailer, LLC (“LAT”), its owners, members, managers, officers, employees, contractors, affiliates, agents, and successors from any and all: (a) claims, demands, actions, causes of action, liabilities, obligations, damages, losses, costs, or expenses of any kind or nature, whether in law or equity; (b) known or unknown, suspected or unsuspected, disclosed or undisclosed, accrued or unaccrued, contingent or actual; (c) arising out of, relating to, or in any way connected with: (i) disputes, disagreements, or conflicts between users; (ii) any rental, use, towing, storage, operation, condition, safety, legality, or roadworthiness of any trailer listed on the Platform; (iii) any communications, negotiations, representations, omissions, or conduct by users; (iv) any reliance on, or use of, information, content, or listings made available through the Platform; and (v) any acts or omissions of users before, during, or after a rental transaction. Users expressly acknowledge that LAT is not a party to any rental transaction and has no control over user conduct, trailer condition, safety practices, payment arrangements, or contractual performance. Users further acknowledge that they assume all risks associated with trailer rentals and interactions with other users. This release is intended to be broad and comprehensive, and applies regardless of the legal theory asserted, including but not limited to negligence (excluding LAT’s own gross negligence or willful misconduct), misrepresentation, strict liability, breach of contract, or any statutory or commonlaw claim. This release survives termination of the user’s account and remains enforceable to the maximum extent permitted by applicable law.
GOVERNING LAW These Terms are governed by the laws of the State of Michigan, without regard to conflict‑of‑law principles. Any legal action must be brought exclusively in state or federal courts located in Michigan, and users consent to the personal jurisdiction of such courts.
MODIFICATIONS TO TERMS LAT may update these Terms at any time. Updated Terms become effective upon posting on the Platform. Continued use of the Platform after such posting constitutes acceptance of the updated Terms.
ACCOUNT SUSPENSION AND TERMINATION 22.1 Suspension and Termination. LAT may suspend, deactivate, or remove any account or listing at its sole discretion, with or without notice, for: (a) violations of these Terms; (b) suspected fraud or misuse; (c) legal or regulatory reasons; (d) any reason deemed necessary to protect the Platform or its users. 22.2 No Refunds. No refunds will be issued for terminated or suspended accounts, except as required by law.
INTELLECTUAL PROPERTY 23.1 Platform IP. All Platform content, branding, software, and technology are owned by LAT or its licensors and are protected by intellectual property laws. 23.2 Restrictions. Users may not: (a) copy, modify, distribute, or create derivative works from the Platform; (b) reverse engineer, decompile, or attempt to extract source code; (c) use LAT’s trademarks, logos, or branding without prior written consent.
COPYRIGHT POLICY (DMCA) 24.1 DMCA Compliance. LAT complies with the Digital Millennium Copyright Act (“DMCA”). If you believe that content on the Platform infringes your copyright, you may submit a notice to LAT’s designated agent containing: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and its location on the Platform; (c) your contact information; (d) a statement that you have a good‑faith belief that use of the material is not authorized; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; (f) your physical or electronic signature. 24.2 Removal and Repeat Infringers. LAT may: (a) remove or disable access to allegedly infringing content; (b) terminate accounts of repeat infringers.
MISCELLANEOUS 25.1 Entire Agreement. These Terms constitute the entire agreement between you and LAT regarding the use of the Platform and supersede all prior agreements or understandings. 25.2 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. 25.3 No Waiver. LAT’s failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or of the right to enforce it later. 25.4 Choice of Law. These Terms and all policies associated with the User’s use or access to the LAT platform shall be construed under the laws of the State of Michigan. 25.5 Assignment. Users may not assign their rights or obligations under these Terms without LAT’s prior written consent. LAT may assign these Terms at any time without notice. 25.5 Notices. LAT may provide notices by posting on the Platform, by email, or by other reasonable means. Users are responsible for maintaining current contact information.
